Chief U.S. District Judge Fred Biery dismissed the patent infringement lawsuit filed by San Antonio, Texas-based e-Watch Inc. against MOBOTIX Corp.
The judgement was entered shortly after the U.S. Patent and Trademark Office (USPTO) had determined, upon MOBOTIX Corp’s request, that one of four patents asserted in the patent infringement lawsuit is not patentable. More inter partes review proceedings requested by MOBOTIX Corp. challenging e-Watch Inc.'s patents are pending at the USPTO. Decisions in these proceedings are expected in the months ahead.
